§ 1. Scope of application

1.1 The following license terms refer to all purchase contracts concluded with w4h.shop - Max Bullmann (manufacturer) for the chargeable versions of the products on the website https://www.w4h.shop as well as the additional and optional licenses produced by w4h.store - Max Bullmann.

1.2 The provisions of this license agreement shall apply exclusively. Verbal side agreements do not exist and possible own terms and conditions of the buyer are not valid. We contradict these already today in advance.

1.3 By purchasing, downloading and installing our products you agree to these license terms. If you do not agree with our license terms, you may not install our products.

1.4 Your right to use our products terminates if you violate one or more of the terms of this License Agreement. In that case, you are obligated to delete our product from your used servers and from your databases. You must also immediately destroy all copies, including the documentation supplied with the product and any modified versions. Further use of our products is excluded in that case, even no longer for testing purposes.

1.5 We are not responsible for content that third parties place in a purchased product. In particular, by distributing the product, we are neither a provider of our own information according to § 8 TDG, nor a service provider of third party information according to § 11 TDG.

§ 2. Scope of license

2.1 The product purchased by you is licensed exclusively for the person on the invoice and is provided exclusively to this person for use.

2.2 You are only allowed one installation of the product per purchased license. Furthermore, you may operate a development installation and use our product there exclusively for testing purposes.

2.3 The development installation may not be publicly accessible and must be secured by you by appropriate measures (e.g. .htaccess protection, local installation, etc.).

§ 3. Duplications

3.1 You may not reproduce our products, make copies of them or distribute them yourself. Further details are regulated in paragraphs 3.2 to 3.4.

3.2 The only permitted use is the installation of our product on one of your servers and in a productive environment.

3.3 You may also perform a development installation on a server accessible only to you.

3.4 You may also perform a data backup. However, this backup is for backup purposes only.

§ 4. Modifications

4.1 You may modify the source code or the translation at your own risk.

4.2 Copyright notices, serial numbers as well as other features of our product serving the software and source code identification, in particular copyright notices visible in the code, if any, as well as the link to our website contained therein may not be removed or changed under any circumstances. The same applies to suppressing or making these features unrecognizable.

§ 5. Liability

5.1 We expressly accept no liability for any damage, errors, loss of data or similar that may arise from the use of our products.

§ 6. Choice of law and place of jurisdiction

6.1 With regard to all legal relationships arising from these license provisions, the laws of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

6.2 If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, Holzminden (Germany) is agreed as the place of jurisdiction for all disputes arising in connection with the performance of this license agreement.
